POLICY
- These Usage Policy and Terms and Conditions, as may be amended from time to time ("Policy") constitute an agreement between ST Engineering e-Services Pte Ltd, (“eServ” or “we”, “us”, “our” as the case may be) and the User (“you” or “your”) with respect to the use of our internet access services (wired or wireless) with our or your devices for use in eServ’s training facilities (collectively the “Service”).
- By accessing the Service, you acknowledge that you have read and understood the terms of this Policy and agree to be bound by the terms of this Policy.
- From time to time, we may in our sole discretion, without liability and without prior notice, update and amend this Policy. Your continued use of the Service following any such revision will constitute that you accede to be bound by the updated terms of the Policy.
THE SERVICE
- The Service is provided to you free of charge and is intended for your learning and/or personal use only in accordance with the terms of this Policy.
- You acknowledge and agree that:
- There are security, privacy and confidentiality risks inherent in internet communications and technology and that you will accept such risks in connection with the use of the Service;
- Your use of the Service may be limited with respect to the number and/or type of devices used to access the Service, as well as the duration of use; and
- Your use of the Service is entirely at your own risk, and that you are solely responsible for all usage of the Service and any loss or damage caused by or in connection with your use of the Service.
ACCEPTABLE USE POLICY
- You shall ensure that your use of and your activities via the Service are not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable.
- Without limiting the generality of Clause 3.1, in respect of your use of the Service, you agree:
- Not to harm or threaten to harm any person or entity in any way;
- Not to transmit or receive software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, any form of "spam" and/or Prohibited Material;
- Not to impersonate any person or entity or falsely state or otherwise misrepresent your identity or status or misrepresent your affiliation with any person or entity;
- Not to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted via the Service;
- Not to abuse and/or misuse the Service in any manner deemed inappropriate by us;
- Not to interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
- Not to hack into the Service or any other related computer system, make excessive traffic demands that may reasonably be expected to inhibit other users from using and enjoying the Service;
- Not to "stalk" or otherwise harass, threaten, or breach the rights of others;
- Not to collect, use, disclose and/or process Personal Data of any third party in breach of applicable laws or otherwise without the knowledge or consent of such third party;
- Not to schedule or program automated log-ins to the Service.
ATTENDING CYBERSECURITY COURSES
- By enrolling and attending cybersecurity-related courses (e.g., ethical hacking), you hereby acknowledge and agree that live demonstrations on threats to cybersecurity may be conducted during such courses.
- You shall indemnify and hold eServ and its directors, officers, agents, representatives, employees and contractors (collectively, “Indemnitees”) harmless from and against any and all damages, losses, liabilities, claims, disputes, judgments, settlements, costs and expenses of any nature whatsoever (including fees and disbursements of attorneys, accountants and other professional advisors) resulting from or arising out of your unauthorized use of the skills learnt from attending such cybersecurity-related courses. You further undertake not to bring a claim against the Indemnitees for any damages, losses, liabilities and/or causes of action resulting from or arising out of such unauthorized use.
- Notwithstanding any prior termination or expiry of the Enrolment Form or completion of class, this provision shall survive for a period of 10 years from the completion of such course.
WARRANTY DISCLAIMER AND EXCLUSION OF LIABILITY
- The Service is provided on an as-is and as-available basis.
- The Service does not prevent You from having extra security such as firewalls on your devices. You should make sure that You have adequate security to prevent unlawful access to or use of the Service, access to your devices or disclosure of confidential information.
- We have no control over and accept no responsibility for any content on the internet. We cannot guarantee the security of the Service against unlawful access or use. You assume full responsibility and risk for accessing content via the Service and the internet and are solely responsible for evaluating the accuracy, completeness, and usefulness of all services, products, and other information, and the quality and merchantability of all merchandise (if any) provided via the Service or the internet. We do not guarantee the integrity, authentication and confidentiality of information, files, documents, data, (including credit card information and PIN) and strongly recommend that You do not exchange or share such information over the internet.
- We do not guarantee that the Service will be compatible with your devices or any software that you may use. Any services, content, sites or resources accessed, downloaded or otherwise obtained through the use of the Service is at your sole responsibility and risk. You voluntarily assume such risk, and you shall be fully responsible for damage to any and all device, computer system or loss of data in the same under your control that results from use of the Services. .
- We disclaim all liability and indemnification obligations for any harm or damages caused by any third-party content and/or hosting providers.
